OPPOSITION GROWS TO SURVEILLANCE PROPOSAL IN EUROPEAN PARLIAMENT 58 ORGANIZATIONS FROM AROUND THE WORLD CALL FOR SUPPORT OF CAPPATO PLAN AGAINST DATA RETENTION MORE THAN 16.000 PEOPLE IN 73 COUNTRIES ENDORSE LETTER TO THE PRESIDENT OF THE EUROPEAN PARLIAMENT On Thursday, May 30, the European Parliament will make a historical vote on the proposal of Directive on the protection of privacy in the electronic communications sector. The Parliament will decide whether EU Member States law enforcement authorities may be entitled to retain all their citizens' electronic communications preventively and potentially in violation of the fundamental right of presumption of innocence, privacy, freedom of expression, and secrecy of communications. In the last few days, the Council has tried, far from the media attention, to push MEPs to change their long-held position to introduce last minute amendments that allow preventive and general surveillance of electronic communications. In response, The Global Internet Liberty Campaign, a group of civil liberties organisations from around the world, launched a campaign urging MEPs to oppose the Council's position and soliciting individuals' support. In a few days only, prominent non-governmental organizations of 15 different countries endorsed the open letter, and more than 16.000 citizens of 73 countries signed it up. WASHINGTON, DC, 28 MAY 2002 - In an open letter sent to all the Members of the Parliament, 58 civil liberties organizations from 15 countries under the banner of the Global Liberty Internet Campaign (http://www.gilc.org), an international coalition of non-governmental organizations, have strongly recommended MEPs to vote against any so-called compromise amendment because it would allow general and exploratory data retention of individuals' electronic communications (telephones, mobiles, SMS and Internet) by law enforcement authorities across the EU. The Council's proposal includes a pro-data retention amendment that has been recently tabled by the Popular and the Socialist groups. The coalition of NGOs urged MEPs to carefully consider the importance of their vote for the protection of fundamental rights and the future of democratic states. Its open letter vigorously rejects any amendment favoring data retention because its language violates well-established international human rights conventions, such as the European Convention on Human Rights and the European Union Charter of Fundamental Rights, as well as the case law of the European Court of Human Rights. In the open letter, the coalition denounces that: "The language of the Council's proposal allows Member States to authorise general and exploratory electronic surveillance on a large scale. While the fight against terrorism is a legitimate purpose, we do not believe it can justify actions that undermine the most fundamental rights of democratic states. New retention requirements will create new risks to personal privacy, political freedom, freedom of speech, and public safety. Wide data retention powers for law enforcement authorities, especially if they were used on a routine basis and on a large part of the population, could have disastrous consequences for the most sensitive and confidential types of personal data."
